It appears to me that you put a lot of weight in your arguement on the Key West auction because of how the title was worded but in the Apache Chip auction not so much... Is it because he put his phone number there also??? I'm sorry but that doesn't make any sense to me.
In my opinion the eBay listing is essentially a binding contract and it needs to be worded clear enough upfront without the need for making phone calls to clear up potentially misleading or potentially false statements...

In my opinion, the language in the title as well as any pictures and descriptions would ALL be part of auction's binding contract/agreement. Since the eBay limits the title descriptions, I too have found that sometimes additional items are listed within the description and/or photos but were not specifically mentioned in the title.
I personally put MORE WEIGHT into what is said in the auction description and the photos included. This is the spot where the seller can say all he wants about what is being sold and provide pictures.
Also as far as the "timing" and ruining Josh's holiday over this... I'm more worried about the poor souls that bought items on eBay over the holidays as gifts for loved ones (or themselves) and ended up getting fooled by all the other sellers trying to take advantage other others especially during the holiday season...
