I would agree that in fairness, the side pot could have been given to the 1 seat.

The regulations here are clear, and any hand is fouled "if any card comes in contact with the discards". As bad as it is for the 1 player, his hand is dead.

I've had hands folded in the 1 seat when I didn't protect them and the muck touched them.
