If a person is on trial for murder with a gun, and the evidence clearly shows the victim was already dead by stabbing when he was shot, then the shooter is not guilty of murder under the facts presented.
If further investigation shows the shooter stabbed the victim to death, then shot him, tough, the shooter has already been found not guilty.

I think I've said that as many different ways as I can. It is a complete scenario. Peanut Butter between 2 pieces of bread is a sandwich. Sure you could have added Jelly, jam, pickles, potato chips, honey, or even cheese, all which would alter the taste of the sandwich. But if the question was...Is peanut butter between two slices of bread a sandwich, the answer is YES.
