ONe issue what reasonable care did the buyer take? What if the magazine used a copy of a photo of the shirt at the thrift store to try and save money actually getting the photo of the original. Hmmm.
Doesn't change the answer to the original hypo. If I am a juror on the issue, I am bound to rule based solely on the evidence presented and not to speculate what else could of been. Hence based solely on the evidence, the seller of the shirt as a Pricess Di would be liable.
