Dave, I have read your posts and hunted down and read Chuck's (and all the others related to your question).
And you have received the legally correct answer. You bear the burden of delivery, unless it was expressly stated otherwise. If you had offered insurance, and made a statement of non liability then the issue changes.
The other point I want to make is this. I don't believe Chuck misstated your position, nor did he approach this as an attack on you. The original post was a question, not mentioning you or the chips, or any other identifiable info.
While I have no doubt your a perfectly genuine guy, I have had nothing but a great chipper relationship with Chuck. I suspect the post was more to determine how to respond to your offer of resolution. He's a good guy, don't presume the worst.
