The argument I was making was really tongue-in-cheek. It is the same argument that was made in the era of McCarthyism and the blacklisting of comunists.

The problem with profiling is that at soem point proff of comitting a crime ceases to be required in order to inflict punishment - all one needs is an accusation. If all that is required for an accusation is fitting a profile, then we might as well just strike words like "liberty and justice" from our pledge of alegiance - because they certainly won't exist for all.
