Below is a translation of IGS's Terms and Conditions which they post at http://www.igsgrading.com/termsandconditions.htm
Their language will be in black followed by my translation in red
_________
IGS attempts to grade items within the time frame offered. However, time frames are estimates and depend upon current volume. IGS is not responsible and will have no liability whatsoever to the customer for incidental or consequential damage due to IGS's failure to meet any time frame. A turn around time frame is not guaranteed by IGS.
You'll get your damn slab when we feel like sending it to you!
IGS will not grade items that show evidence of trimming, recoloring, restoration or any other form of tampering, or are of questionable authenticity. In the event IGS rejects any item for grading, the fee paid by the customer for the grading service WILL NOT be refunded; this is because the determination to reject a item will require review by IGS's grading experts.
We might not even do what we were hired to do. We might just mail it back to you and keep your money
Grading involves individual judgments that are subjective and require the exercise of professional opinion which can change from time to time. Therefore, IGS makes no guarantee or representation and shall have no liability whatsoever to the customer for the grade assigned by IGS to any item.
Even though you pay us for our expert opinion, in the hopes of inducing others to trust our opinion, we will not stand behind our opinion. If we made a mistake we won't even give back our fee
IGS will exercise reasonable care in handling items submitted for grading. However, if IGS determines that the customer's item was lost or damaged while in IGS's possession, the customer will be compensated in accordance with IGS's standard procedures and not necessarily based upon the insured value the customer assigned to the item.
If we lose or damage your item, we will compensate you by paying you whatever we feel is fair regardless of the items actual value
The customer must inspect all items immediately upon receipt and report any damage or discrepancy to IGS within ten (10) days of the customer receipt of items.
If you don't claim the damage within 10 days we are not even going to pretend to compensate you even though in our previous T&C we pretty much destroyed any hope you might get of receiveing fair compensation if you report it timely.
IGS shall have no liability whatsoever to the customer for any damage to any item, or otherwise, resulting from the breaking open of the IGS holder.
We don't want you checking up on our grading so don't even think of removing the item from our holder and submitting it to another grader (or even back to us to see if we grade it the same way).
IGS shall have no liability whatsoever to the customer for any damage to any item that IGS can reasonably demonstrate occurred while not in the custody or control of IGS.
Seems reasonable since we already basically disclaimed liability for damage that occurs while it is in our possession we also want to make sure that there is no point when we are ever liable for any damage whether or not we caused it.
It is absolutely necessary that items submitted for grading to IGS be packed and shipped strictly in accordance with the requirements of the IGS submission instructions. IGS shall have no liability whatsoever for any damage to any item shipped or delivered to IGS in a manner that does not strictly conform to IGS's written specifications.
Just reiterating that there is no way that we will ever have to pay you for a lost or damaged item period end of discussion. And by the way if you read our submission form the only shipping instructions that we have (other tahn some recommendations) is that you ship the item securely to prevent movement.
Except as expressly set forth herein, IGS disclaims any and all warranties expressed or implied, regarding our services.
Since there are no warranties expressly set forth here, there are no warranties at all. Meaning we can do whatever we damn well please and we don't have to back it up or stand behind our service
IGS's liability for errors in labeling and/or grading is limited to IGS's charges for grading only.
Ok we keep saying that we have no liability, but seems a bit harsh. How about we do this, if we make a mistake we will refund your fee. Oh course since we already told you that grading is subjective so you will never be able to establish that we made a mistake.
IGS makes no warranty expressed or implied in regards to value of items after grading.
Even though we will tell you that getting your item graded will make it more valuable, we won't stand behind that claim.
IGS accepts responsibility of customer submitted items while in our secured grading facilities.
Ok you win we will agree that while we have your items we are responsible for them despite the fact that we previously said we weren't/ And just remember that while we responsible for your item if it is lost or damaged we will pay you whatever WE feel is fair regardless of actual value and you will take it or leave it.
IGS is not responsible for any injuries as a result of tampering and/or item removal from our holders.
we previously suggested that you not try to regrade your items by threatening that in removing the item from a holder it may be damaged. On second thought that wasn't strong enough. We want you to know that if you try to do this you might suffer a personal injury, and we will not be held responsible. And remeber its not just you who could be injured, it could be your children --- Don't screw with us
FAQ’s are also a part of IGS's terms and conditions.
we have hidden additional terms in hard to find places throughout our website. You are bound by them so go hunt them down to read them. If you find them you might notice One that reads as follows:
Does IGS buy or sell cards?
Answer:No.
now in case you don't know hat this means this means that we din't buy or sell cards under the IGS name. We also make the same claim about coins. We do however not promise that we aren't selling items under other names. For example the fact that we share a common phone number with cardsone (www.cardsone.com) should not in any way shape or form act to convince you that we in fact self slab and then sell our items. And even though our website doesn't make the same claim for casino chips you can forget the fact that we sent a letter to the Casino Chip and Gaming Token Collectors Club President and told him that it was our intention to buy chips grade them and sell them. Of course we make a point of telling you that we don't do this with coins or cards because if you had any intelliegence whatsoever you would understand that this creates a substantial conflict of interest.
