I'll bet you a 100 to 1 that you are not sued by Mr. Heppler. My experience is that anyone who threatens to sue you is only doing so in order to get you to do something that they want you to. If they really had intentions of suing you why would they tell you in advance? It would only hurt their case against you. But there really isn't a case. Since Mr. Heppler is engaged in an illegal activity, he has no basis for seeking relief in the courts. You know what they say ... those with the least in their heads wind up making the most noise.
