Negative Feedback Situation

I am looking for opinions. I have 2 different stuations going on at the same time.

Item#1 is chip related. I recenlty won 2 $100 recently released Palms chips for about $75 each. The seller contacts me and says that the chips aren't his, their his buddies and when the buddy finds out that the high bids are below face, he refuses to give the ebay seller the chips. I have attempted to contact this seller again, but no response at this time. At this point I do not want to pay for them, because I probably won't see them, but I also want to avoid negative feedback. Is it too much to ask to have them shipped COD, even if he decides to complete the transaction, which it doesn't sound like he will. He has over 100+ positive feedback. I do not know the seller, but have seen him post on this board. I have never given negative feedback, that is until today on item #2.

Item #2 is NCR, but almost similar circumstances, except that this guy just plain refuses to ship the item because he paid more for it than I had bid, which was the highest bid without reserve. How do I find this out. One of my favorite searches brings up the exact same item I just won, rather unique item. I then see that je has relisted the item again and today, another seller left negative feedback on the same item from an auction previous to mine.

I'm looking for any ideas. Never had 1 problem, much less 2 at the same time.

Your thoughts would be appreciated.
