If he resigns on or before September 15th then by law a special election has to be held and the Democrats risk losing the seat to a Republican but if he resigns on or after September 16th then New Jersey Senate President Richard Codey becomes the Acting Governor until the November 2005 Elections. McGreevey will resign on November 15th and Codey will take over the Governorship until next year.

As a side note I live in Senator Codey's district and I can tell you first hand as a constituent he and his staff are NOT a very nice people. They are not interested in listening to what their constituency has to say and when you call his office his staff usually will blow you off. I for one am not looking forward to having Codey sitting in the Governor's seat in Trenton.
