In every Sales Law class, students learn the laws of risk in shipping. The parties may agree to alter the basic rules. The law is not simple enough for me to recall it off the top of my head, but there are terms for many different ways to alter the assumption of risk during delivery. Unfortunately, I do not know the magic words you need to use in an auction.
