It's the process that is flawed, not the bidder's action. An auction should end when there are no further bids ... not because a timer has run out.

Can you imagine the club auction at convention being run under similar conditions? Let's see; "Lot #123 is now open for bidding. Bidding will end in 1 minute and 8 seconds. Last bid received before the timer goes off is the winner."
