John, I attended an eBay seminar last weekend and asked just this question.

Basically, the answer I received was that no matter who we talk to, eBay is not going to change their policy. They cannot logistically change the policy for one listing category, and will not change it for the entire site because of the risk of sellers listing items that are illegal to sell.

Ultimately, I was told to get over it and figure out a different way of listing items.
