My recollection, however, is that this was just, as I said, a statement of future intended action, not actually a "decision". As I said, there is nothing in the brass core reports to indicate that any such vote was ever taken. And, since no complaint was ever filed against David, any such statement would be, as we lawyers like to say , dicta.

I agree that this was a mistake, whether it was an actual decision or just a gratuitous comment.
