Hanging the Confederate flag... isn't that protected under the US Constitution?

What are the crime statistics in the states where the death penalty can be applied? How many crimes are committed where the death penalty can be awarded? How many were performed by race? How many (as a percentage) received the death penalty? If you're a lawyer, fix it... if there's a problem, the root-cause would have to be lawyers improperly defending their clients.
