In Texas V Johnson, the court ruled that flag burning was Constitutionally protected free speech. It was a 5-4 decision. Brennan, Kennedy, BLackmun, Marshall, and Saclia were in the majority.
Rhenquist, White, O'Connor, and Stevens dissented.
Perhaps the most interesting thing here is that two conservative Reagan appointees ruling that flag buring is protected. Most intersting is Scalia -- one of the most Conservative judges on the court over the past two decades, and in my opinion, the most intelligent.
