Legally Speaking ...
In Response To: Shipping & Insurance Debate ()

From a legal point of view, unless otherwise stated, it is the seller's responsibility to get the item to the buyer in good condition. The seller bears the responsibility for the cost of shipping which includes postage, insurance, any other expenses like packaging, and for loss or damage of the item in shipment.

The seller may, however, demand different terms and conditions. The seller can demand that the buyer pay for the cost of shipping. The seller may make insurance an option for the buyer. The buyer then has to decide whether or not to purchase under these terms and conditions. If the buyer accepts these terms and conditions, then the buyer becomes responsible for the shipment.

I know that from a legal point of view, I am not 100% accurate, but that is what I remember from my contracts class. Maybe the lawyers among us can clear up anything this not totally accurate.
