With all that I think John owns his own scans and the publication is responsible for paying him, for the right to use them, or at the least acknowledging the source with Thanks.

He has documentation and dates to prove they are his.

I think it's outrageous that they would steal the scans and then claim they had ownership and John couldn't use them. Use them all over John and ask them to take you to court, you will win.
