If it was OK for Gene to have the chips made because he had no "intention of defrauding anyone" (regarding which I haven't the slightest doubt), then it is OK for anyone else who has no such intention to have them made as well.
And, if it was OK for Gene to have them made, how can it not have also been OK for David Whalen to make them.
So, where does that leave us? Whalen is banished and Gene is commended (not a knock on Gene -- I agree with your assessment of what he did). Talk about hypocritical, though.
As for the difference between "owning" and "distributing" these chips, how does anyone other than Whalen ever "own" one unless it is "distributed"?
