Actually since there is no nation on the other side of this "war" and its not even clear that there is a single organized entity on the other side, and the people in this country who have been detained have not been in any apparent military activity against the US the true nature of the activity you call a War is much more in line with criminal activity not warfare.
The proposition you support is a dangerous. "The Government may declare any person any time to be an enemy combatant lock them up with no rights and not even accord them the rights accorded a POW under the Geneva Convention."
The Pre-Revolution British could have made the same argument that you currently make. We rejected that argument then . . . I still reject it.
