As a general rule the use of civil courts in personal injury actions is to compensate the injured party (NOTE I AM ASSUMING THAT YOU CAN PROVE LIABILITY). Therefore the amount a party found responsible for causing an injury would have to pay would be determined by the injury. There are a few exceptions to this general policy and I'm not going to address them because they are not necessarily relevant to your question.
