On you second point...... I was thinking in terms of private, personal use (like downloading a scan for inclusion in my database of chips), and very much NOT for commercial purposes. I suspect however, that it is likely illegal regardless of the purpose (except where it meets the test of fair-use).
Regarding your first point..... I would venture to say that the Dunes image depicted on the chip is owned by some entity other than Randy. I would further venture to say that Randy did not request their authorization to "copy" that image and post it on a public system, let alone use it for commercial purposes. Although it is highly unlikely that Randy will be sued, I suspect that his action, and the actions of many of us (I include myself) are contrary to the copyright laws.
I suspect that Greg Susong may be up against this right now with the Wisconsin casino that is objecting to his use of their blackjack chip.
Lastly, but still on the first point, since you asked me "Why doesn't Randy have the righ to post this scan on his website?" I ask you....
What 'right' does Randy have to post the scan?
