Ask permission first before I use someone else's scan though most of the time I do my own scans but lately my printer/scanner has been acting up and not working so I've had to resort to using a third party's scan but I always put the following disclaimer under the picture:

So by all means you should be very angry with this eBay seller because I have been in the same situation and in fact I caught one guy trying to pawn my $5 Holiday Inn Boardwalk Grand Opening picture from an auction that I held on eBay and when I confronted him about it he immediately denied that he stole the picture but I had an ace in the hole, I put a watermark in the picture which he didn't know about and after I told him and he found the watermark his story suddenly changed and he then claimed he got the picture from a friend.
You know there are scripts that you can use to prevent right clicking on a webpage. I have one that I use all the time on my eBay auctions. They are not 100% but at least for those who don't know how to get around these scripts and try to steal an image they won't be able to.
