I think if Brian were to try for a refund, first, then he may not need to be concerned with leaving a negative feedback... and, if his attempt to receive a refund fails after 3-months, he can wait for the 59th minute; in the 24th hour; of the 90th day to zap the seller withoutout a worry of receiving a negative feedback in reurn.
