When you are 3 miles out, I believe that you are in international waters. I believe that there is maritime law that applies in international waters, but I doubt that it covers gaming. If you killed someone in international waters, I am sure that you can be prosecuted. But if you cheat your customers at blackjack, I don't think you have to worry much about prosecution. Maybe lost customers, but not jail time.
