Personally, I would demand a refund as the seller was a little bit less than upfront with his dinky, little scan & less than descriptive description. If he refuses, I'd hammer him with a neg feedback. Of course he will probably return the favor but who do you think it's going to hurt the worst, you with 832 positives or him with 4???
