The distinction is not games of chance Vs, Games of skill or they'd have to get rid of the craps tables, roulette wheels, bingo, etc.
Slot machines are not legal in NY (yet) but they do have these video slots which do not except coin and work on the premise of being video Keno games with slot style displays.
They have video poker, but quite frankly I am suspicious of the machines and believe that they may not really operate as other video poker does (the video Keno elements of the slots seem to be present) which would mean that if I am right the video poker games could not be considered games of skill.
In any event while in light of the recent deals made under pressure from the financial strain of the WTC attacks there will be an expansion of gambling in NY, however I doubt very highly that this particular casino will actually ever open.
The sovereignty issue of Indian Tribes is probably the most complex legal issue in American Law and quite frankly I have no practical understanding of it. But the commments of the Tribe's spokesman make it clear that they are ignoring many complex issues.
I expect that what additional casinos we may see in NY will be primarily in the western region of the State.
