You feel that eBay's User Agreement does not allow this, although you admit that the User Agreement Frequently Asked Questions says it's allowable, and instructs the seller exactly how to do it:

If you can't accept that the User Agreement FAQ's are part of the User Agreement, then there's nothing more to discuss. Take it up with eBay if you feel that you are right and they are wrong.

I think anyone who wades through this thread, and bothers to check out the eBay policies on this subject, can draw their own conclusions.
