If the casinos refused to accept this provision, it would disappear. The chip manufacturers need the casinos a lot more than the casinos need any specific manufacturer. I have negotiated many contracts, including huge so-called "form" leases prepared by major corporate landlords. Have never found one who wasn't willing to negotiate specific terms to get the right name on the dotted line.
I guarantee there is a manufacturer out there which would, for the right order, accept an agreement which allowed the casino to retain the copyright of the artwork (with, perhaps, a license for the manufacturer to use for promotional purposes). Once any one manufacturer accepted this, others would be forced to follow suit.
Just takes one casino owner/manager/whatever with gumption enough (and a lawyer smart enough) to insist on it. Assuming, of course, that they care whether someone else owns the copyright to something with their name on it!! <g>
