Nothing can be stolen if you don't own it. Scanned pictures are not creative work, the original is. And yes if someone tries to resell someone's published picture the are violating copyright laws. If what you were say was true I could scan or take a picture of you, put it on the internet, make money from it somehow and you would have not recourse against me. I'll bet you would.
